1. About this Privacy Notice

Ashbury College strives to ensure that our use of Personal Information of data subjects is lawful, reasonable, and relevant to our business activities, with the ultimate goal of improving our offerings and your experience.

This notice applies to Ashbury College. References to “AC”, “we”, “us” or “our” in this notice mean Ashbury College.

AC respects privacy and is committed to protecting the privacy of visitors to this site. We seek to employ best practice when it comes to the collection and processing of personal information in accordance with data protection or privacy legislation.

Where we provide links to websites of other organisations, this Privacy Notice does not cover how that organisation processes personal information. If you follow a link to any website, please read the privacy notice of that website before you submit any personal information. AC is not responsible for information captured and processed on any website linked to our website.

This Online Privacy Notice sets out what we will do with any Personal Information we collect from or about you, or that you provide to us, when you use our services, including our website and parent’s portal, or when you enrol at the school. Please read this Privacy Notice carefully to understand our views and practices regarding your Personal Information and how we will treat it.

It is important that you read this Privacy Notice together with our website terms and conditions and any other document or agreements which describe the manner in which we may collect or process personal information about you.

If you are a consumer as defined in the Consumer Protection Act 68 of 2008, we have a duty to draw certain important terms to your attention. Clauses 8 and 11 limit and exclude obligations, liabilities, and legal responsibilities that we may otherwise have — as a result, your rights and remedies against us may be limited. Clause 11 means you take on certain risks, legal responsibilities, and liability.

2. The Personal Information we will collect about you

AC may collect, receive, record, organise, collate, store, update, change, retrieve, read, process, analyse, use, and share your Personal Information as set out in this Privacy Notice.

“Personal Information” refers to private information about an identifiable person (natural or juristic). The type of personal information we collect may differ based on the services you receive from AC. We may process the following kinds of personal data:

  • Identity Data — name, date of birth, gender, identity number, photographs, and copies of identity documents.
  • Contact Data — addresses, email addresses, and telephone numbers.
  • Financial Data — bank account details, payment information, and financial statements.
  • Transaction Data — details about payments to and from you.
  • Service Data — information about your interactions with AC and your learner’s academic performance.
  • Security Data — records of access to our facilities.
  • Technical Data — IP address, browser type and version, time zone, operating system, and other technology on the devices you use to access the website.
  • Usage Data — information about how you use our website.
  • Communications Data — your communication preferences.

If any information you provide contains special personal information (such as health, religion, or race information), your consent is the lawful basis on which we rely to process such information unless another lawful basis applies.

We do not provide services directly to children. Our site is not available for use by any person under the age of 18 without consent and supervision from a parent or legal guardian.

3. How we collect your Personal Information

We collect personal information through direct interactions with you — for example, when you complete an enquiry or application form, communicate with us by email or telephone, or enrol a learner at the school. The information we may actively collect includes any of the categories listed in section 2.

Personal information provided to AC will only be used for the purposes stated when it is requested. We may use your personal information to:

  • provide our educational services to you;
  • administer our education programmes;
  • operate our facilities;
  • comply with our statutory obligations and interact with regulatory authorities;
  • retain and make information available to you on the website;
  • provide marketing that is relevant to you;
  • establish and verify your identity;
  • diagnose and deal with technical issues and user queries;
  • operate, administer, maintain, secure, and develop the website;
  • protect our rights in any litigation;
  • detect, prevent, or deal with actual or alleged fraud or unauthorised use of the website;
  • communicate with you and keep a record of our communications; and
  • inform you about any changes to the website or this Privacy Notice.

AC will restrict its processing of your Personal Information to the original purposes for which it was collected, unless we reasonably consider that it is required to be processed for another compatible purpose.

5. Sharing your Personal Information

We will not intentionally disclose your Personal Information for commercial gain or otherwise, other than as set out in this Privacy Notice or without your permission.

6. Circumstances in which we may share your Personal Information

  • To our agents, advisers, service providers, and suppliers who have agreed to be bound by this Privacy Notice or equivalent terms.
  • To our employees, service providers, and agents to the extent necessary to provide services to us (such as website hosting, technical support, and debt recovery). We will enter into written agreements with such third parties containing confidentiality and non-disclosure provisions.
  • In order to enforce any contract between you and us.
  • In order to protect our rights, property, or safety, or that of our learners, staff, or any third party.
  • To governmental agencies or regulatory bodies if required to do so by law or if we reasonably believe such action is necessary to comply with the law, protect the rights or safety of any person, or detect or prevent fraud.

7. How we store information

Personal information is held only for as long as is necessary to provide services to you, or as required by legislation, business requirements, or whichever period is the longest. Details are available on request from the AC Information Officer.

Personal information you provide will be stored electronically on our servers or those of our service providers, as well as in hard copy format where necessary, with reasonable organisational and technical safeguards in place.

8. Quality and protection of your information

We make every effort to keep personal information updated, complete, and accurate. It is your duty to provide AC with your most up-to-date personal information. You can do so by emailing chane.nel@ashburycollege.co.za.

AC strives to ensure the security of personal information by taking reasonable measures to prevent destruction, unlawful access, and loss of personal information. Any compromise of data integrity or confidentiality will be reported to you by written notice. Even with these measures in place, we cannot guarantee that your personal information is 100% secure.

Please contact us at the email address above if you:

  • require access to any personal information we hold about you;
  • wish to notify us of any change, modification, or correction; or
  • would like to have your personal information removed from our records.

We will require suitable proof of identity before actioning any of the above requests.

9. Cookies

Our website uses cookies — small files of letters and numbers placed on your computer or mobile device. Cookies allow us to distinguish you from other users, provide a good browsing experience, and improve our website. You may accept or decline cookies using the banner displayed on your first visit to our site.

10. Access to information

11. Waiver

You agree that where the law requires us to make you aware of something or to do something else, we do not have to do this to the extent that the law permits a waiver of such obligations. This clause only applies as far as the law allows.

12. Your rights under data protection laws

Under certain circumstances you may have the right to:

  • Request access to your personal information (a data subject access request).
  • Request correction of any incomplete or inaccurate data we hold about you.
  • Request erasure of your personal data where there is no lawful basis for us continuing to process it.
  • Withdraw consent at any time where we are relying on consent to process your personal information.
  • Object to our processing or use of your personal information in accordance with applicable data protection legislation.

13. Consumer Protection Act and POPIA

If any part of this Privacy Notice is regulated by or subject to the Consumer Protection Act or the Protection of Personal Information Act, No. 4 of 2013 (“POPIA”), it is not intended that any part of this Privacy Notice contravenes any provision of either Act. All provisions of this Privacy Notice must be treated as being qualified, to the extent necessary, to ensure compliance with the Consumer Protection Act and POPIA.

14. Governing law

To the maximum extent possible, South African law applies to this Privacy Notice. If any provision of this Privacy Notice is found to be illegal, void, or unenforceable by a court of competent jurisdiction, it shall be deemed deleted and the remainder of the provisions will continue in full force and effect.
